3 positive results against Marriott valued at £61,909

We are pleased to inform you of this week's Spanish court victories. M1 Legal secured SIX positive awards with a total value of £103,976.

Here is a breakdown of our substantive results:

1st Court of Instance:

  • Marriott x 3 - In Marbella court No's. 6/8, in all three cases, the judge declared the contract null under the requirements of law 42/1998 (lack of information regarding the contract duration).  Amounts Awarded - £12,064, £34,364, £15,481.

 Appeals:

  • CLC Continental - In the Court of Appeal No.4, Jaén, the judgement has been confirmed from the first instance which declared the contract null due to lack of information regarding the contract duration. We also won court costs.  Amount Awarded - £23,283.
  • Anfi - In Las Palmas court No.3, the judgement in this case also has been confirmed from the first instance that declared the contract null due to lack of information regarding the contract duration. Amount Awarded - £11,723.

Jurisdiction:

Seven positive results valued at £156,590

This week we received notification of seven positive jurisdiction results, three against CLC Paradise Trading, one against CLC Continental Resorts, one against CLC UK PLC, and two against Diamond Resorts.  In all seven cases, the defence argued that the cases(s) should not be heard in Spain, however, the judge ruled that they can and will proceed to the next step.
